1. Definitions

  • Client: Any user who purchases, installs, and uses WP Recurring Payments on one or more WordPress sites.

  • Developer: Ignacio Gil Álvarez, creator and owner of the WP Recurring Payments plugin.

  • Plugin: WP Recurring Payments, a software tool that enables subscription automation and management in WordPress using WooCommerce.

  • License: The non-exclusive right granted to the Client to use WP Recurring Payments in accordance with the terms outlined in the license agreement.


2. Service Description

WP Recurring Payments is a plugin designed to manage and automate recurring payment subscriptions on WordPress-based websites using WooCommerce. The Client is responsible for configuring and maintaining their payment gateways and WooCommerce environment. The Developer does not process payments and is not responsible for issues arising from payment gateway setup, configuration, or malfunction.


3. Limitations and Responsibilities

  • Payment Gateway Configuration: The proper setup and maintenance of payment gateways (e.g., Stripe, PayPal) are the sole responsibility of the Client. The Developer is not responsible for any payment failures, incorrect charges, or missed renewals.

  • Generated Subscription Data: The Developer does not guarantee the accuracy, performance, or completeness of subscription data generated or stored through WP Recurring Payments.

  • Legal Compliance: The Client must ensure that their use of the plugin complies with all applicable laws and regulations in their jurisdiction, including those relating to data protection, consumer rights, and recurring billing.


4. Plugin Usage Conditions

  • Available Licenses: WP Recurring Payments offers various license types that allow installation on a different number of sites:

    • Basic: Allows the plugin to be used on 1 WordPress site.

    • Pro: Allows the plugin to be used on up to 3 WordPress sites.

    • Enterprise: Allows the plugin to be used on up to 5 WordPress sites.

  • Usage Environments: The Client may install and use the plugin in both production and development environments, as long as the number of installations does not exceed the license limits.

  • Usage Restrictions: The Client agrees not to:

    • Redistribute, resell, lease, license, sublicense, transfer, or offer the plugin or any of its files to third parties.

    • Claim credit or intellectual property ownership over the code or any other assets provided by WP Recurring Payments.

    • Use the plugin for illegal or unauthorized purposes.

    • Exceed the number of installations allowed by the purchased license.

  • Lifetime Licenses: In addition to time-based licenses, WP Recurring Payments may also offer lifetime licenses. These licenses grant perpetual usage rights based on domain limits (e.g., 1, 3, or 5 sites), depending on the plan selected. If the plugin is ever discontinued, no further updates or support will be provided, but the Client may continue using the latest available version under the terms of their license.


5. Plugin Liability Disclaimer

WP Recurring Payments is provided as a tool to assist with subscription management and automation within WordPress. While the Developer strives to ensure compatibility and stability, no guarantees are made that the plugin will operate flawlessly in all environments or with all third-party themes and plugins.

The Developer is not liable for:

  • Any direct, indirect, or consequential damages, including loss of revenue or client data.

  • Conflicts with other plugins, themes, or custom code.

  • Misconfigurations or improper use of the plugin.

  • Errors resulting from updates to WordPress, WooCommerce, or third-party services.

  • Any malfunction or interruption in the plugin’s operation.

The Client is responsible for testing the plugin in their environment and ensuring its compatibility with their specific WordPress setup before using it in production.


6. Payment Processing Disclaimer

The WP Recurring Payments plugin facilitates the use of payment gateways such as Stripe and PayPal, but it does not process payments itself. The Developer is not responsible for:

  • Failed, delayed, or incorrect payments.

  • Issues or downtimes with external payment providers.

  • Disputes between the Client and their customers regarding billing or charges.

  • Any legal obligations arising from the Client’s use of payment systems.

The Client must monitor and ensure that all payment configurations and processes are working as expected within their store.


7. Disclaimer of Warranties

WP Recurring Payments is provided “as is” and without any express or implied warranties. This includes, but is not limited to, warranties of functionality, fitness for a particular purpose, non-infringement of third-party rights, or that the plugin will be error-free or that its use will be uninterrupted. The Client assumes full responsibility and risk for using the plugin.


8. Payments and Refunds

  • Payments: All payments for WP Recurring Payments licenses are securely processed through WooPayments. Ignacio Gil Álvarez does not store, process, or have access to credit card information or other financial data.

  • Refunds: Clients are entitled to request a refund within 7 days of purchase if the Plugin does not perform as expected, provided that they have not used a free trial license. The Developer reserves the right to deny refunds if abuse of the trial system is detected or if the refund request does not meet the established criteria.


9. Ownership

All intellectual property rights in WP Recurring Payments, including but not limited to source code, graphic materials, functionality, and documentation, are the exclusive property of Ignacio Gil Álvarez. The purchase of a license grants only the limited right to use the plugin under the terms of the license and does not transfer any ownership rights to the Client.


10. Updates and Support

  • Updates: The Developer reserves the right to release updates that improve the plugin’s performance, fix bugs, or add new functionality. The Client is entitled to receive updates as long as their license is active.

  • Support: Technical support will be provided by Ignacio Gil Álvarez via email at [contact@wprecurringpayments.com]. Response times may vary, but every effort will be made to resolve technical issues as quickly as possible. Support is only guaranteed for clients with an active license.


11. Termination

The Developer reserves the right to discontinue support and updates for the plugin at any time and without prior notice. In the event support is discontinued, current clients will be notified in a timely manner via email.


12. Privacy Policy

The use of WP Recurring Payments is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the Plugin, you agree to the terms of our Privacy Policy. Please review our Privacy Policy for further details.


13. Changes to the Terms

The Developer reserves the right to modify these terms and conditions at any time. Changes will be posted on the official WP Recurring Payments website and clients will be notified via email. It is the Client’s responsibility to regularly review the terms to stay informed of any changes.


14. Indemnification Clause

The Client agrees to indemnify, defend, and hold harmless Ignacio Gil Álvarez from any claims, damages, losses, costs, expenses, or any other liabilities, including legal fees, that arise from:

  • The Client’s use of the plugin in violation of these terms and conditions.

  • Any third-party claims related to the improper use of the plugin, including violations of intellectual property or copyright laws.


15. Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Scotland.
